These Terms of Service ("Terms") govern your access to and use of messaging services, APIs, portals, and related products offered by Send99 ("Send99", "we", "us") at send99.com. By creating an account, purchasing credits, or sending traffic through our systems, you agree to these Terms and to our Privacy Policy and Refund Policy.
Send99 provides application-to-person (A2P) SMS and related connectivity (including HTTP APIs and SMPP) for lawful business messaging. We route messages through mobile network operators and aggregators. Service availability, features, and pricing may vary by destination, sender ID type, and regulatory regime.
You are solely responsible for the content of messages you originate, the accuracy of recipient lists, and compliance with all applicable laws and industry rules (including consent, identification, quiet hours, and marketing restrictions). You must not use the service for unlawful, harmful, or deceptive purposes.
You may not send or facilitate messages that violate law or carrier/operator acceptable-use policies, including without limitation: spam or unsolicited bulk messaging without valid consent; malware or phishing; harassment, hate, or threats; adult or illegal services where restricted; fraudulent financial schemes; content that infringes intellectual property; or messages designed to evade filtering, spoof recipients, or mislead as to origin.
SMS delivery depends on third-party networks, handset state, routing, and filtering. We do not guarantee delivery, delivery speed, or final handset display. Delivery reports (DLRs) and message states reflect information returned by downstream carriers and may be delayed, incomplete, or inconclusive. You acknowledge that "sent" or "submitted" status does not guarantee user receipt.
Certain countries require sender registration, distributed ledger technology (DLT) filings, template approval, numeric or alphanumeric sender ID rules, or content categories. You are responsible for obtaining approvals and supplying accurate registration data. Operators may block, throttle, or alter traffic that fails policy checks. Fees may still apply to submitted messages that are filtered or rejected downstream.
We may verify your business identity and use case. We may refuse service, throttle traffic, suspend or terminate accounts, or remove access to features if we reasonably believe you have breached these Terms, created risk, or are subject to legal or carrier action. We may cooperate with lawful requests from authorities and carriers.
Fees are as quoted on your order, rate card, or portal. Many products are prepaid credits consumed per message segment or API call. You are responsible for applicable taxes. Unused balances may be subject to the Refund Policy. Chargebacks or payment disputes may result in account suspension.
Send99 retains all rights in its software, documentation, and branding. We grant you a limited, non-exclusive licence to use the service for your internal business purposes in accordance with these Terms. You may not reverse engineer, scrape, or resell the service except as expressly agreed in writing.
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim implied warranties where allowable. To the maximum extent permitted by law, Send99 will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms is limited to the amounts you paid to Send99 for the service giving rise to the claim during the three (3) months before the event, except where liability cannot be limited by law.
You will defend, indemnify, and hold harmless Send99 and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your messages, lists, content, or breach of these Terms or applicable law.
We may update these Terms by posting a revised version on this page and updating the effective date. Material changes may also be communicated by email or portal notice where appropriate. Continued use after the effective date constitutes acceptance.
